1. Website terms and conditions
The website www.woomwomen.com.au (Site) is operated by WOOM, a sole trader based in Australia (ABN 39 299 072 105) (WOOM). Your access to and use of the Site is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers contained in this document and elsewhere on the Site (collectively, the Terms). WOOM reserves the right to amend the Terms at any time without prior notice. Your continued use of the Site following any changes constitutes your acceptance of those changes. If you do not agree to the Terms, you must cease using the Site immediately. If you breach the Terms, WOOM may suspend or terminate your access to the Site.
2. Intellectual Property
All content on the Site, including text, graphics, images, branding, logos and other material (Content), is owned by or licensed to WOOM and is protected by Australian and international intellectual property laws. You must not reproduce, distribute, modify or otherwise use any Content without prior written consent from WOOM. Nothing on the Site grants you any licence or right to use any intellectual property without express permission.
3. Use of Site
You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of WOOM or any third party. You must not interfere with the Site, attempt to gain unauthorised access, distribute harmful material, or engage in any activity that disrupts the functionality or security of the Site. If you create an account or place an order, you must provide accurate and complete information and maintain the confidentiality of your account details.
4. Hyperlinks
The Site may contain links to third-party websites. These linked sites are not controlled by WOOM, and WOOM is not responsible for their content, accuracy or practices. Accessing third-party websites is at your own risk.
5. Privacy
Your use of the Site is subject to our Privacy Policy, which is available on the Site. By using the Site, you consent to the collection and use of your information as outlined in that policy.
6. Products and health disclaimer
The information provided on the Site is for general informational purposes only and is not medical advice. Our products are not intended to diagnose, treat, cure or prevent any condition. You should seek advice from a qualified healthcare professional before using any products, particularly if you are pregnant, breastfeeding, or managing a medical condition. Use of products is at your own discretion.
7. Pricing and availability
All prices are in Australian Dollars (AUD) and include GST where applicable. Prices and product availability are subject to change without notice. WOOM reserves the right to correct any errors and to cancel or refuse orders where necessary.
8. Payment and orders
Payment must be made at the time of purchase. Orders are subject to acceptance and availability. WOOM may cancel or refuse any order at its discretion, including where there is a pricing or product error. If payment has been taken, a refund will be issued.
9. Shipping and delivery
Shipping costs are calculated at checkout. Orders are typically dispatched within 1–5 business days. Delivery timeframes are estimates only. Risk in goods passes to you upon delivery, to the extent permitted by law. If your order arrives damaged, you must contact us as soon as possible.
10. Promotions and offer codes
Promotional codes are subject to the conditions specified at the time of issue. Codes are generally single-use, non-transferable and cannot be combined with other offers unless stated. WOOM reserves the right to cancel or refuse any promotion at any time.
11. Gift cards
Gift cards issued by WOOM are valid for a minimum of three (3) years from the date of purchase, in accordance with Australian law. Gift cards are non-transferable and cannot be redeemed for cash. Gift cards may be used for purchases on the Site only. If the total order value exceeds the gift card balance, the remaining amount must be paid using another payment method. If the order value is less than the gift card balance, the remaining balance will remain available for future use. WOOM is not responsible for lost, stolen or unauthorised use of gift cards.
12. Bundles and promotional sets
From time to time, WOOM may offer products as part of bundles or promotional sets. Bundle pricing may differ from the total price of individual items. Unless required under Australian Consumer Law, items purchased as part of a bundle must be returned together to be eligible for a refund. If a partial return is accepted, WOOM reserves the right to adjust the refund amount to reflect the individual item value.
13. Returns and refunds
Returns and refunds are subject to our Returns Policy, available on the Site. Nothing in this section excludes your rights under the Australian Consumer Law.
14. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any rights you have under the Australian Consumer Law or applicable New Zealand consumer laws. Where required by law, you are entitled to a repair, replacement or refund.
15. Disclaimer
The Site and its Content are provided on an “as is” basis. While we aim to ensure accuracy, WOOM does not guarantee that the Site will be error-free, uninterrupted or free from harmful components. Your use of the Site is at your own risk.
16. Limitation of liability
To the fullest extent permitted by law, WOOM is not liable for any indirect or consequential loss arising from your use of the Site. However, nothing in these Terms excludes liability that cannot be excluded under law, including under the Australian Consumer Law.
17. Indemnity
You agree to indemnify WOOM against any claims, damages or expenses arising from your misuse of the Site or breach of these Terms.
18. General
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms are governed by the laws of Victoria, Australia. By using the Site, you submit to the jurisdiction of the courts of Victoria.
